Terms of Service for Kelmiv

1. Agreement to Terms

By accessing or using Kelmiv ("the Service"), operated by Khawaja ("us", "we", or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service globally.

2. Pinterest Compliance

2.1 Pinterest Policies Compliance

Kelmiv operates in full compliance with Pinterest's Developer Guidelines, API Terms of Service, and Community Guidelines. We require all users to adhere to Pinterest's policies as well.

By using Kelmiv, you acknowledge that:

You will not use Kelmiv to violate any Pinterest policy.
You are responsible for all actions taken on your Pinterest account through our Service.
You must comply with Pinterest's Community Guidelines and Advertising Guidelines.

2.2 Data Usage

In compliance with Pinterest's Developer Guidelines, Kelmiv:

Does not store Pinterest data permanently; we call the Pinterest API in real-time for information.
Does not combine your Pinterest data with data from other services (except as necessary to provide our Service).
Does not sell or share your Pinterest data with third parties for advertising or any other purpose.
Only accesses your account with your explicit authorization (OAuth 2.0).
Requires manual action for publishing; we never automate actions without your specific consideration.

2.3 User Responsibilities

You agree to:

Use Kelmiv only for legitimate purposes that comply with Pinterest's policies.
Manually select and approve each Pin before scheduling (no auto-publishing without review).
Not use Kelmiv to spam, harass, or engage in inauthentic behavior.
Not attempt to automate actions that should be genuine, such as following, unfollowing, or commenting.
Comply with all applicable laws and regulations.

3. Subscriptions, Payments, and Billing

Billing Cycle: The Service is billed on a subscription basis ("Subscriptions"). You will be billed in advance on a recurring and periodic basis (monthly or annually, depending on your selection).
Automatic Renewal: At the end of each billing cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it.
Payment Processing: All payments are processed securely through our authorized merchant of record, Paddle. By subscribing, you agree to Paddle's checkout terms and conditions.
Fee Changes: We may modify the Subscription fees at any time with prior notice before changes take effect.

4. Accounts and Security

When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms. You are responsible for safeguarding the password that you use to access the Service.

5. AI-Generated Content and Intellectual Property

The Service utilizes Artificial Intelligence to generate text and images.

Your Rights: Subject to your compliance with these Terms, you retain all rights, including commercial rights, to the AI-generated outputs created through your account.
Our Rights: The original software, algorithms, UI/UX, and branding of Kelmiv remain the exclusive property of Kelmiv and its licensors.

6. Limitation of Liability

To the maximum extent permitted by law, Kelmiv and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use or alteration of your transmissions or content. Our total liability shall not exceed the amount you paid us in the last 12 months.

7. Indemnification

You agree to indemnify and hold harmless Kelmiv and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
